US Court Orders Release of Abrego Garcia from ICE Detention

A federal judge has ordered the immediate release of Kilmar Abrego Garcia from immigration custody, finding his ongoing confinement is without legal authority.

"Since his return from erroneous imprisonment in El Salvador, he has been re-detained, again without lawful authority," the judge wrote in her ruling.

The case originates in a mistaken removal to El Salvador earlier this year, which the government later acknowledged was an error. Following his repatriation to the United States to answer human smuggling allegations, he was detained in federal custody.

In her decision, the court noted that the authorities does not have a current removal order, which effectively blocks them from removing Mr. Abrego Garcia "at this time."

Background of the Legal Challenge

The legal challenge center on conflicting claims. Whereas the Trump administration contends that Abrego Garcia is a member of the MS-13 gang, he vehemently denies this claim.

He has also pleaded not guilty to the conspiracy counts, which are part of a separate criminal case in Tennessee.

Conditions of Freedom

The judge, who was overseeing his challenge to removal in a federal court, ruled that he must now comply with the conditions of his release from jail in Tennessee. This decision effectively transfers his supervision to the Tennessee court.
